The rules of the road for using Pounce On It — what you get, what you pay, and what we both agree to.

Pounce On It is a missed-call SMS automation platform designed for home-service businesses (HVAC, plumbing, electrical, and similar trades). When a customer calls your business phone and the call goes unanswered, Pounce On It automatically sends them an SMS text follow-up to qualify the lead and schedule a callback.

We reserve the right to refuse service to any business or individual whose use violates these terms or applicable law.
Pricing: $149/month, billed monthly.
Free Trial: All new accounts receive a 14-day free trial at sign-up. You provide payment details (via Stripe) during registration. Your card is not charged until the trial ends. A reminder email is sent 3 days before billing begins.
Auto-billing: After the 14-day trial, your card on file is automatically charged $149/month on the same calendar day each month (monthly cycle).
Failed payments: If a payment fails, we will retry it within 5 days. If payment is not collected within 14 days of the initial failure, your account will be suspended and the service will pause until payment is received.
Upgrades and downgrades: You may change your subscription at any time. Upgrades take effect immediately and are prorated. Downgrades take effect at the start of the next billing cycle.
All prices are in USD. Prices are subject to change with 30 days' notice sent to the account email address. Price changes apply at the next billing date after the notice period.
You may cancel your subscription at any time from your account settings or by emailing support@pounceonit.co.
You agree to use Pounce On It only for lawful business purposes. Prohibited uses include:
Violations may result in immediate suspension or termination of your account without refund. We reserve the right to report illegal activity to law enforcement authorities.
SMS messages are sent via Twilio's A2P 10DLC (Application-to-Person 10-Digit Long Code) messaging product. A2P 10DLC is regulated by U.S. mobile carriers and requires compliance with the CTIA Messaging Guidelines and Twilio's Acceptable Use Policy.
You are responsible for ensuring that your SMS messaging use complies with Twilio's terms and applicable carrier rules. By using Pounce On It, you agree to our SMS Terms & Consent Policy, which covers opt-out requirements, message frequency, and carrier disclosures.
Opt-out must be honored immediately. Any reply of STOP, CANCEL, UNSUBSCRIBE, QUIT, END, or STOP ALL must result in immediate removal of that phone number from your messaging list.
Pounce On It aims for high availability but does not guarantee uninterrupted service. Uptime may be affected by planned maintenance, infrastructure issues, or third-party service disruptions (Twilio, Stripe, or database providers).
If Pounce On It is unavailable for more than 48 continuous hours, affected customers will receive a pro-rated service credit at our discretion.
Pounce On It and its platform, design, code, logo, and content are the property of Pounce On It and are protected by U.S. copyright and trademark law. You retain ownership of your business data, lead information, and any content you provide.
We grant you a limited, non-exclusive, revocable license to use the platform during your active subscription. This license does not include the right to resell, sublicense, or reproduce any part of the service without our written consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POUNCE ON IT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
In no event shall Pounce On It be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the service — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Pounce On It, its affiliates, officers, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
We may suspend or terminate your account immediately, without prior notice, if:
Termination for non-payment does not relieve you of liability for unpaid subscription fees. We may delete your account and data 90 days after termination.
These Terms of Service are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any dispute arising from these terms or your use of Pounce On It shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
Class action waiver: You agree that any dispute resolution will be conducted on an individual basis only — not as a class, consolidated, or representative action.
We may update these Terms of Service from time to time. Material changes will be communicated via email to the account email address at least 30 days before taking effect. Continued use of Pounce On It after a change takes effect constitutes acceptance of the updated terms.
